N,N-DMT is illegal in most western countries; however, N,N-DMT's stronger cousin 5-MeO-DMT remains unscheduled and uncontrolled in all but a handful of countries, thus making it technically legal.

N,N-DMT is Schedule I in the United States. This means it is illegal to manufacture, buy, possess, or distribute (sell, trade or give) without a DEA license.

5-MeO-DMT (5-methoxy-N,N-dimethyltryptamine) is not listed in the US Schedules of Controlled Substances. To be safe one needs to also check their individual STATE laws; as it is believed Nebraska and N. Dakota have recently scheduled 5-MeO-DMT, making it illegal.

Good advise would be to make sure you check too see which DMT drugs are legal in your country. It might be that none of them are. For example, it is believed that Germany, Denmark, UK, New Zealand, Greece, Sweden, and Switzerland have all listed N,N-DMT and 5-MeO-DMT as Schedule I drugs. Be sure you are fully aware of your countries laws.
